Not all assets can or should be retained but sometimes it is essential to retain some aspect as a public facility as well as enabling a commercial disposal of other aspects.

We advise on, and deal with, disposals pursuant to S123 (2A) of the Local Government Act 1972, including drafting contract documentation to ensure retention of public facilities at no cost to the authorities, whilst enabling operation of the commercial aspects. We address rights of way, car parking, easements and other land issues.

Working closely with the Police and local businesses, Colchester BC was granted an indefinite injunction which forbids any begging and any person being in possession of alcohol in any form of open container within the town centre.

Our team supported the establishment of the first local authority Social Impact Bond and we support commissioning organisations exploring such investment.

We supported the procurement of a provider and deliverer using the competitive dialogue procedure.

We provide bespoke drafting for new models of delivery along with the drafting of an outcomes contract and payment mechanism. We work with funders’ solicitors on investment and banking documents.

We are working with HM Treasury to assist with setting up templates contracts and a tool kit for future Social Impact Bonds.
